What specifically is prohibited by the law?
The amendments to Maui County Code Section 13.04.020 prohibit smoking and the use of tobacco products within the limits of any park or recreational facility which is owned or maintained by the County. This includes chewing tobacco, and smoking cigarettes, cigars, pipes, or other products containing tobacco.

Some people have made the switch to vapor devises, or e-cigarettes. Are these included in the Maui County ban?
No, they are not included in the ban at this time.

Which beaches and parks are covered by the ban?
All beaches and parks owned or maintained by the County, and the Waiehu Golf Course, are included in the ban. To view a listing of all County parks by geographic district, visit www.mauicounty.gov/parks and click on the “County Parks Listing” tab on the left.

Is Waiehu Golf Course included in the ban?
Yes, Waiehu Golf Course is a County Park facility; it is included in the ban.

Are swimming pools and community centers included in the ban?
Yes, all swimming pools and community centers owned or maintained by the County are included in the ban.

Are parking lots included in the ban?
Yes, the tobacco ban applies to any parking lot owned or maintained by the county for a County Park facility, including those for beaches, parks, swimming pools, and community centers which are County owned or maintained.

When does the law go into effect?
The law went into effect as soon as it was signed, on April 22, 2014.

How will the tobacco ban be enforced?
Maui Police Officers, Park Security Officers, authorized law enforcement personnel, and other authorized department enforcement personnel may issue citations, or warnings, for violations of this tobacco ban. (Maui County Code Section 13.04.235)

What are the penalties for violations?
Penalties for violating the tobacco ban are set forth in Maui County Code Section 13.04.230, which provides that any person who is determined to have violated Maui County Code Section 13.04.020, which prohibits engaging in smoking or the use of tobacco products within the limit of any park or within any recreational facility, shall be fined not less than $150 and not more than $500.
